NOTICE IS HEREBY GIVEN BY THE TOWN OF PATTERSON BOARD OF APPEALS of a public hearing to be held on Tuesday, July 12, 2011 at 7:00 p.m. at the Patterson Town Hall, 1142 Route 311, Patterson, Putnam County, New York to consider the following applications:
1) Patricia Tanzi Case #03-11 – Special Use Permit – Held over from the March 16, 2011 and April 25, 2011 meetings.
Applicant is requesting a Special Use Permit and area variances pursuant to §154-105 of the Patterson Town Code, Accessory Apartments, in order to legalize her existing accessory apartment. §154-105 A(3) of the Code requires the floor area of the apartment to be no less than 400 square feet and no more than 600 square feet; Applicant has 2,400 square feet; Variance requested is for 1,800 square feet. §154-105 A(4) of the Code states that the floor area of the apartment shall not exceed 35% of the entire livable floor area of the single-family principal dwelling and the accessory apartment combined; Accessory apartment is 44% of the entire livable floor area; Variance requested is for 9%. This property is located at 405 Fair Street (R-4 Zoning District).
2) Dino Rentoulis Case #09-11 – Area Variance
Applicant is requesting an area variance pursuant to §154-67 A(2) of the Patterson Town Code, Signs in business districts. Applicant has an existing 132 square foot freestanding sign; The Code allows for freestanding signs to be no more than 25 square feet; Variance requested is for 107 square feet. This property is located at 2970-2974 Route 22 (C-1 Zoning District).
3) Dino Rentoulis Case #10-11 – Use Variance
Applicant is requesting a use variance pursuant to §154-34 of the Patterson Town Code, Permitted principal uses, in order for a residential use to be permitted in the C-1 Zoning District. The two bedroom residence attached to the restaurant has lost its pre-existing, nonconforming status and is no longer a permitted use in the C-1 Zoning District. This property is located at 2974 Route 22 (C-1 Zoning District).
4) Caleb Smith Case #11-11 – Area Variances
Applicant is requesting area variances pursuant to §154-58 of the Patterson Town Code, Enlargement of nonconforming buildings, and §154-7 of the Patterson Town Code, Schedule of Regulations, in order to replace and enlarge the existing rear deck and construct a new 2nd story deck above. The Code requires a minimum side yard setback of 30’; Currently exists is 10’; Applicant will have 10’. The Code also requires that not more than 12% of the lot be covered by impervious surface; Currently exists is 42%; Applicant will have 43%; Variance requested is for 31%. This property is located at 6-8 First Street (R-1 Zoning District).
5) Putnam Lake Fire Department Case #12-11 – Area Variance
Applicant is requesting an area variance pursuant to §154-7 of the Patterson Town Code, Schedule of Regulations, in order to construct a 12’ x 18’ training station platform to the rear of the existing fire station. The Code requires a re yard setback of 25’; Applicant will have 13’; Variance requested is for 12’. This property is located at 72 Fairfield Drive (GB Zoning District).
6) Joseph Downey Case #13-11 – Area Variance
Applicant is requesting an area variance pursuant to §154-7 of the Patterson Town Code, Schedule of Regulations, in order to replace and enlarge his existing garage and attached shed. The Code requires the to be a 25’ rear yard setback; Applicant will have 1’; Variance requested is for 24’. This property is located at 149 Stagecoach Road (R-4 Zoning District).

Town of Kent Planning Board
NOTICE IS HEREBY GIVEN that a public hearing will be held before the Town of Kent Planning Board on July 14, 2011 at 7:30 PM, or as soon thereafter as the matter may come to be heard, at the Kent Town Hall, 25 Sybil’s Crossing, Kent Lakes, New York, for the purpose of considering an application for re-approval of a Site Plan, and Steep Slope and Erosion Control Permit approvals submitted by Mountain View Realty, c/o John Ostuni, involving a ±26 acre site identified as tax lot number 12-1-44, located on Route 52, Kent, New York. The applicant seeks authorization to develop the site for office and contractor yard uses including: 1) a 23,850 square foot building; 2) a 13,300 square foot building; 3) an 11,000 square foot building; and 4) associated driveway, parking, water supply, sewage disposal, and storm water management facilities. The subject property is located in the Industrial/Office/Commercial (IOC) District. All persons in interest may appear in person, by agent, or by attorney, and all will be heard. The Kent Planning Board was previously and continues to be the Lead Agency for this application and is coordinating the environmental review of this action.

ACCEPTANCE OF RECYCLED MATERIALS
GARBAGE DISTRICT NO. 2
NOTICE IS HEREBY GIVEN that sealed bids for the acceptance and removal of recycled materials from Garbage District No. 2 located at the Patterson Recycling Center, Town of Patterson will be received by the Town of Patterson at the office of the Town Clerk, 1142 Route 311, P.O. Box 470, Patterson, New York 12563 until 2:00 p.m. on Monday, July 18, 2011 and then at said place be publicly opened and read aloud.
All of the bids must meet the specifications of the Town of Patterson. Copies of the information for bidders, general requirements, bid specifications, non-collusive bidding certification, and bid proposal forms may be obtained at the office of the Town Clerk. Bids must be submitted at the above address in sealed envelopes and must bear on the face thereof the name and address of the bidder and the following inscription: "Acceptance of Recycled Materials."
The Town of Patterson reserves the right to reject any and/or all bids and to re-advertise for new bids. Bids shall be awarded in accordance with General Municipal Law § 103.

NOTICE TO BIDDERS
Sealed proposals for performing the work herein described will be received by the Town Board of Patterson, New York, at the Office of the Town Clerk, Town Hall, 1142 Route 311, Patterson, New York 12563, on July 25, 2011 at 2 PM and immediately thereafter the bids will be publicly opened and read aloud in said office.
The work consists of constructing separate turn lanes on Route 311 and on the off ramp approaches of I-84 (includes associated drainage improvements). Other related work shall include preparing, restoring and cleaning the project area all in accordance with the plans and specifications as prepared by the Engineer.
Contract Documents may be obtained at the above office of the Town Clerk on or after 9 AM., June 30, 2011 upon payment of a cash deposit of $150.00 for each set, which will be refunded only if a bid is received and documents returned in good condition. Plans will not be available for review, purchase only.
Bids shall be made on the separate Bid Proposal Forms furnished with the Specifications and must be accompanied by a Bid Bond acceptable to the Town or a certified cashier's check drawn on a solvent bank in the amount of not less than 5% of the total amount of the Bid. Checks shall be made payable to the Town of Patterson, New York, and are to be held by the Town as a guarantee for the proper execution and delivery of the Contract and bonds to secure the faithful performance thereof. In default of such execution and delivery of Contract and Bonds, the amount of the deposit represented by the check shall be forfeited to and retained by the Town of Patterson as liquidated damages.
Proposals shall be enclosed in a sealed envelope bearing the name and address of the Bidder, addressed to the Town of Patterson, The Town Hall, 1142 Route 311, Patterson, New York and endorsed "Roadway Improvements NYS Route 311 and 1-84 Interchange, PfN# 8ME047.30A, Patterson, New York."
The Town of Patterson reserves the right to reject any and all Bids, to waive any informality in any Bid, and to award the Contract to other than the lowest Bidder if deemed in the best interest of the Town to do so.
This contract will be awarded by the Town of Patterson, however, the improvements are being funded by the New York State Department of Transportation (NYSDOT). Therefore, the award will also be subject to NYSDOT rules and regulations.
