LEGAL NOTICE
A regular meeting of the Town Board of the Town of Patterson in the County of Putnam, State of New York, was held at the Patterson Town Hall, 1142 Route 311, Patterson, New York on December 14, 2011
PRESENT:
Michael Griffin, Supervisor, Councilwoman Ginny Nacerino, Councilman Kevin Burns, Councilman Edward O'Connor ABSENT: Councilman Joseph Capasso In the Matter of the Establishment of a Park District within the Town of Patterson, County of Putnam, State of New York to be known as the Putnam Lake Park District
ORDER CALLING PUBLIC HEARING
WHEREAS, the Town Board of the Town of Patterson (the "Town Board" and the "Town," respectively), in the County of Putnam, State of New York, has received a petition (the "Petition"), dated August 23, 2011, pursuant to Article 12 of the Town Law of the State of New York, for the establishment of the Putnam Lake Park District (the "District"), which petition is signed by the owners of taxable real property situate in the proposed District, owning in the aggregate at least one-half of the assessed valuation of all the taxable real property of the proposed District, as shown upon the latest completed assessment roll of said Town, and including the signatures of resident owners of taxable real property owning taxable real property aggregating at least one-half of the assessed valuation of all the taxable real property of the proposed District owned by resident owners, all according to the latest completed assessment roll; and
WHEREAS, the Petition describes the boundaries of the proposed District in a manner sufficient to identify the lands included therein in the same manner as in a deed of conveyance, and was signed by the petitioners and acknowledged or proved in the same manner as provided by the Election Law for the authentication of nominating petitions, all in accordance with the applicable provisions of Article 12, Section 191 of Town Law; and WHEREAS, the proposed District is bounded and described as follows: All those certain parcels or lots of lands or portions thereof, lying in the Town of Patterson, County of Putnam, New York, designated and delineated on the following maps filed in Putnam

13th Map Putnam Lake-Filed 3-20-31-Map N0.149-L ;and WHEREAS, the proper name of Filed Map No. 149-L is "10th Map Putnam Lake", but the Town Board believes that this "scrivener's error" is insignificant since the Filed Map number and the date of filing clearly indicate the property proposed to be included in the District; and WHEREAS, the Town Board will give due consideration to the impact that the establishment of the District may have on the environment and on the basis of such consideration, the Town Board will determine the environmental impact, if any, to be caused by the establishment of the District; and WHEREAS, the stated purposes for which the District is proposed to be established include the managing, maintaining and improving the proposed "park district property" described in the Petition, and the making of necessary improvements to the waters of Putnam Lake for the use, convenience and enjoyment of the residents within the District; and WHEREAS, the Petition does not propose the construction of any improvements; and WHEREAS, the Petition proposes that the yearly cost to properties within the District shall not exceed $.47 per $1,000 of the assessed valuation of property, and that the facilities of the District will be for the exclusive use of Putnam Lake residents; NOW THEREFORE, BE IT: ORDERED, that a meeting and public hearing of the Town Board of the Town be held at the Patterson Recreation Center, 65 Front St., Patterson, New York on January 18, 2012,(snow
date January 24, 2012) at 7:30 p.m., or as soon thereafter as the matter can be heard, to consider the establishment of the proposed District herein referred to, and to hear all persons interested in the subject thereof concerning the same, and for such other action on the part of the Town Board with relation thereto as may be required by law; and be it FURTHER ORDERED, that the Town Clerk publish at least once in the Putnam County Courier, a newspaper having a general circulation in the Town and hereby designated as the official newspaper of the Town for such publication, and post on the sign board of the Town maintained pursuant to Subdivision 6 of Section 30 of the Town Law, and on the Town's website, a copy of this order, certified by said Town Clerk, the first publication thereof and said posting to be not less than ten nor more than twenty days before the day designated for the hearing as aforesaid; and be it FURTHER ORDERED, that the Town Clerk file a certified copy of this order with the Comptroller of the State of New York on or about the date of publication of a copy of this order; and be it FURTHER ORDERED, that prior to the publication of a copy of this Order, the Town Board shall cause to be prepared, and file for public inspection with the Town Clerk, a detailed explanation of how the estimated cost to a typical property within the proposed District was computed.

Project Description:
The project sponsor proposes to remove and replace an existing pool house and patio. The new pool house, modified pool and storage facility will be partially constructed within the regulated 100 foot adjacent area of NYSDEC Freshwater Wetland OL-7 (Class I) and result in 1,891 square feet of permanent impacts. In addition, the project sponsor proposes to install a 6'x 12' floating dock within the wetland boundary.

State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

It has been determined that the proposed action is not subject to CP-29.

NOTICE OF RECEIPT OF TAX ROLL
AND
WARRANT
TAKE NOTICE, that I, Sally Parfitt, the undersigned Receiver of Taxes of the Town of Patterson, County of Putnam and State of New York, have duly received the tax roll and warrant for the year 2012 and I will attend at the Town Hall in said Town of Patterson, Monday through Friday, from 9:00 a.m. to 3:00 p.m. except holidays. Saturday, January 21, 2012 from 10:00 a.m. to 1:00 p.m. at the Patterson Town Hall and Saturday, January 28, 2012 at the Putnam Lake Firehouse from 10:00 a.m. to 1:00 p.m. for the purpose of receiving taxes listed on said roll. TAKE FURTHER NOTICE, that taxes may be paid on or before January 31, 2012 without charge of interest. On all taxes received after that date there shall be an added interest of 1% for each additional month or fraction thereof until such taxes are paid or until return of unpaid taxes to the Commissioner of Finance, pursuant to law. TAKE FURTHER NOTICE, that in accordance with Town Resolution 1295-06, an additional penalty of $2.00 will be assessed against each parcel for which taxes remain unpaid, and for which a second notice is mailed.
TAKE FURTHER NOTICE, that pursuant to the provisions of law, the Tax Roll of the
Town of Patterson will be returned to the Commissioner of Finance of the County of Putnam on the first day of April 2012.
