Board of the Town of Carmel
held on the 9th day of
January, 1985 at the Town
Hall, McAlpin Avenue,
Mahopac, New York.

At the meeting of the
establishment of a Refuse
and Garbage District for the
Town of Carmel pursuant to
Article 12-A of the Town
Law.
WHEREAS, the report,
plan of the proposed
system and map have been
prepared and are on file
in the Office of the Town
Clerk, and WHEREAS, the
improvement proposed is
as follows:
To cause, regulate and
directly contract with others
for the collection of garbage
and refuse within the Town
of Carmel.
and
WHEREAS, the maximum
amount to be expended
annually for such service
shall be the annual cost
of the service contract or
contracts, and
WHEREAS, no capital
improvements are proposed,
no public works are required
nor are lands or easements
to be acquired, and
WHEREAS, the proposed
method of financing the cost
of said improvement shall be
obtained from a user charge
levied annually against all
properties located in and
serviced by the district on
a unit price basis, and
WHEREAS, the proposed
district is to be described as
follows:
The district shall be the
geographical and legal
boundaries of the Town of
Carmel arid shall consist
of only those properties as
are designated single family
residence (Prop. Type 210),
two family residence (Prop.
Type 220), three family
residence (Prop. Type 230),
rural residence (Prop. Type
240), estate (Prop. Type
250), seasonal residence
(Prop.
Type 260), mobile home
(Prop. Type 270), multiple
residences (Prop. Type 280),
apartments (Prop. Type 411),
condominium (Prop. Type
412), in accordance with the
Property Type Classification
Code promulgated by the
New York State Division
of Equalization and
Assessment as shown on the
Tax Assessment Roll o£ the
Town of Carmel.
NOW, on motion of
Councilman Della Cioppa,
seconded by Councilman
Noonan, it is hereby
ORDERED AND
RESOLVED, that the Town
Board of the Town of Carmel
shall hold a public hearing
at the Town Hall, McAlpin
Avenue Mahopac, New York
at 7:00 p.m. on January 30,
1985 to consider such map,
plan of proposed service and
report and to hear all persons
interested in the subject
thereof and for such other
and further action on the
part of the Town Board
with respect to the- proposed
district as may be required
by law, and it is further
ORDERED AND
RESOLVED, that any
interested person may
examine the map, plan of
proposed service and report
which are on file in the
Office of the Town Clerk of
the Town of Carmel between
the hours of 9:00 a.m. and
5:00 p.m. at Town Hall,
McAlpin Avenue, Mahopac,
New York, and it is further
ORDERED AND
RESOLVED, that the Deputy
Town Clerk shall give notice
of such hearing by publishing
in the official newspaper of
the Town of Carmel a copy
of this order and by posting
a certified copy of this order
on the official sign board
maintained by the Town of
Carmel, not less than 10 nor
more than 20 days before
such hearing.

RESOLUTION
WHEREAS the Town
of Carmel is desirous of
changing the present method
of garbage collection in the
town, and is desirous of
obtaining some municipal
control over solid waste
collection, and
WHEREAS pursuant to
Section 209-c of the Town
Law, a map, plan and report
have been prepared and
filed with the Office of the
Town Clerk regarding the
establishment of a townwide refuse and garbage
improvement district for
residential properties, and
WHEREAS a notice of
public hearing was duly
published and a public
hearing held on January
30, 1985 regarding the
establishment of said
district, and
WHEREAS the proposed
district is to be described
as follows:

The district shall be
the geographical legal
boundaries of the Town of
Carmel and shall consist

WHEREAS the creation
of a refuse and garbage
improvement district would
represent the first step in
the effort to obtain some
municipal control over solid
waste collection, and
WHEREAS pursuant to the
intermunicipal agreement
between the Town of Carmel
and the County of Putnam,
the town is obligated to
obtain control over solid
waste collection while the
county is responsible for
the disposal of said solid
waste, and
WHEREAS, the sanitation
district would provide a legal
mechanism for financing a
new collection system for
residential properties in
the Town of Carmel known
as the contractual method
of collection, whereby the
town and not individual
homeowners would contract
with the private sector for
residential collection,
and
WHEREAS, the total cost
of the contractual system
shall be paid by the district
which shall be financed by
a special tax assessment to
district property owners on
a per unit basis, and
WHEREAS, studies
have indicated that said
contractual system should
be the most economical and
administratively feasible
collection method for a town
the size of Carmel, and
WHEREAS said
contractual system of
collection has been working
successfully in numerous
nearby communities, and
WHEREAS the Town of
Carmel shall implement
said collection system only
upon receipt of bids from
the private carters that the
proposed system is in the
best interests of the Town
of Carmel, and
WHEREAS ho capital
expenditures will be incurred
by the creation of the refuse
and garbage district, nor is it
anticipated that any monies
will be borrowed or debts
incurred, and
WHEREAS the
establishment of the district
will enable the Town of
Carmel to provide a uniform
system of solid waste
collection for residential
properties, and will enable
the town to regulate
collection services and
costs, and
WHEREAS the
establishment of the
district will help discourage
residential property owners
from dumping garbage along
roadsides and in commercial
containers,
NOW, THEREFORE,
BE IT RESOLVED AS
FOLLOWS:
(1) That the aforesaid
notice of public hearing was
published and posted as

required by law, and was
otherwise sufficient;
(2) That all the property
and property owners within

DISTRICT
Councilman Della Cioppa
addressed the Board with
an up-date informational
review as to the time frame
of the progress of the
proposed garbage collection
district referendum. He
presented the Board with
three proposals:
1. Mr. Della Cioppa
motioned that the
referendum to create the
Garbage District be held on
April 20, 1985 between the
hours of 9:00 AM to 6:00 PM
at the Lakeview School and
Mahopac Falls Elementary
Schools in Mahopac and
the Carmel Fire Department
station. This motion was
seconded by Councilman
Terhune and all the Board
members voting aye. Motion
carried.
2. Mr. Della Cioppa
motioned that the Town
Attorney write up and
prepare for publication
by the Town Clerk the
referendum abstract to be
voted upon by the voters.
This motion-was seconded
by Councilman Noonan
and all the Board members
voting aye. This motion was
so ordered by Mr. Othmer.
3. Mr. Della Cioppa
motioned the Board hold
a special informational
session and hearing on
April 18, 1985 at 7:00 P.M.
This motion was seconded
by Councilwoman Stahl.
All Board members except
Councilman Terhune voting
Aye, he voted Nay with
the explanation that this
Board has had too many
hearings and sessions
concerning the formation
of the garbage collection
district, The general public
is well informed asserted
Mr. Terhune. This motion
carried.

ESTABLISHING A
GARBAGE AND REFUSE
COLLECTION DISTRICT
WHEREAS, and on
January 9, 1985 the Town
Board of the Town of Carmel
adopted a Resolution subject
to permissive referendum
creating and establishing
a garbage and refuse
collection district within
the Town of Carmel, and
WHEREAS, a petition was
presented to the Town Board
in proper form and signed
by the requisite number of
property owners within the
aforesaid district requesting
that a referendum be held,
andW
HEREAS, and on April
20, 1985, a special election
was held on the following
proposition:
“Shall the Town of Carmel
create a special district to
cause, regulate and directly
contract for the collection
of residential refuse and
garbage within the Town
of Carmel.”
and
WHEREAS, a majority
of the eligible voters voted
to approve the aforesaid
proposal, and
WHEREAS, the Town
Clerk of the Town of Carmel
has so certified the result of
the aforesaid election.
NOW, THEREFORE be it
RESOLVED, that the Town
Board of the Town of Carmel
has
determined that the
legal requirements for the
establishment of the Town
of Carmel Garbage and
Refuse Collection District
have been met and that
such proceedings shall be
presumptive evidence of
regularity as provided by
statute, and be it further
RESOLVED, that the
Town Clerk of the Town of
Carmel is directed to file a
certified copy of this order
with the Clerk of the County
of Putnam and the New York
State Department of Audit
and Control.
