PROGRAM OF PROJECTS
FOR 49 USC §5317
-Public Hearing Notice-
A Public Hearing will be held upon written request of any and all interested parties to provide for comment on Putnam County’s 49 USC §5317 Grant Application(s). Projects to be funded by the U.S. Department of Transportation, Federal Transit Administration. This application is for the design and construction of five (5) segments of ADA accessible sidewalks in the towns of Southeast and Carmel, which will connect bus routes with existing sidewalks and the bikeway. The grant application also includes two (2) years of Mobility Manager to assist our disabled residents with transportation alternatives in Putnam County. The “ADA Transit Accessibility II” project will cost $612,000 including $489,600 Federal funds and $122,400 local match. The “Mobility Manager” project will cost $116,000 including $92,800 Federal Funds and $23,200 local match. Together, both projects in the application cost $728,000 of which 80% will be Federal funds ($582,400); and 20% will be the local share ($145,600). The application file for the projects can be reviewed at the following address:

1) Patricia Tanzi Case #03-11 – Special Use Permit – Held over from the
March 16, 2011, April 25, 2011 and October 19, 2011 meetings
Applicant is requesting a Special Use Permit and area variances pursuant to §154-105 of the Patterson Town Code, Accessory Apartments, in order to legalize her existing accessory apartment. §154-105 A(3) of the Code requires the floor area of the apartment to be no less than 400 square feet and no more than 600 square feet; Applicant has 2,400 square feet; Variance requested is for 1,800 square feet. §154-105 A(4) of the Code states that the floor area of the apartment shall not exceed 35% of the entire livable floor area of the single-family principal dwelling and the accessory apartment combined; Accessory apartment is 44% of the entire livable floor area; Variance requested is for 9%. This property is located at 405 Fair Street (R-4 Zoning District).
2) Nejame & Sons (Crivelli) Case #09-12 – Area Variances – Held over from the April 17, 2012 meeting
Applicant, on behalf of Paul and Jennifer Crivelli, is requesting area variances in order to install a 12’ x 20’ in-ground swimming pool in the front yard. §154-27 A.(12)(a) of the Code states that pools shall not be located in the front yard. New York State Code requires there to be a minimum 4’ fence around a pool. Because of the multi-level property and retaining walls, the fence will be fastened to the front of a stone wall, making the fence 8’ from grade on the lot frontage. §154-15
A. of the Patterson Town Code; Fences, stone walls and masonry walls, states that a fence shall not exceed 4’ from ground level along the frontage; Variance requested is for 4’. This property is located at 24 South Lake Drive (RPL-10) Zoning District).
3) Joseph Downey Case #10-12 – Area Variances – Held over from the April 17, 2012 meeting
Applicant is requesting area variances pursuant to §154-7 of the Patterson Town Code, Schedule of regulations and §154-58 of the Patterson Town Code, Enlargement of nonconforming buildings. Applicant wishes to construct an 8’ x 30’ extension to both the south side and the north side of his dwelling. Currently, there is a 30’ side yard setback on the north side; Code requires a 40’ side yard setback; Applicant is proposing 21’; Variance requested is for 19’. Applicant also wishes to enlarge his front porch and add a 2’ extension to it. The Code requires a
front yard setback of 40’; Applicant is proposing 12’; Variance requested is for 28’. The Applicant also wishes to construct a 10’ x 20’ addition to the south side of the detached garage. The Code requires a variance in order to increase the size of a pre-existing, nonconforming garage. This property is located at 149 Stagecoach Road (R-4 Zoning District).
4) Christopher Rini Case #11-12 – Area Variance
Applicant is requesting an area variance pursuant to §154-7 of the Patterson Town
Code, Schedule of regulations, in order to replace and enlarge his rear deck from 6’ x 12’ to 14’ x 18’. The Patterson Town Code requires there to be a 40’ side yard setback; Applicant currently has 37’; Applicant will have 34’; Variance requested is for 6’. This property is located at 29 Ludingtonville Road (R-4 Zoning District).
5) James Cherry Case #12-12 – Area Variances
Applicant is requesting area variances in order to construct a 2nd story addition to his single family dwelling and also to legalize an existing shed. Applicant has already started construction on the 2nd story addition and is requesting a variance pursuant to §154-58 of the Patterson Town Code, Enlargement of nonconforming buildings. The Code requires there to be a side yard setback of 40’; Applicant has 14’ on the easterly side and 31’ on the westerly side of his dwelling. Applicant also has an existing 8’ x 10’ shed located in the front yard and 2’ from the side property line. The Code does not permit sheds to be located in the front yard. The Code also requires there to be a 20’ side yard setback; Variance requested is for 18’. This property is located at 10 River Road (R-4 Zoning District).
