NOTICE IS HEREBY GIVEN BY THE TOWN OF PATTERSON BOARD OF APPEALS of a public hearing to be held on Monday, November 21, 2011 at 7:00 p.m. at the Patterson Town Hall, 1142 Route 311, Patterson, Putnam County, New York to consider the following applications:
1) Patricia Tanzi Case #03-11 – Special Use Permit – Held over from the March 16, 2011, April 25, 2011 and October 19, 2011 meetings.
Applicant is requesting a Special Use Permit and area variances pursuant to §154-105 of the Patterson Town Code, Accessory Apartments, in order to legalize her existing accessory apartment. §154-105 A(3) of the Code requires the floor area of the apartment to be no less than 400 square feet and no more than 600 square feet; Applicant has 2,400 square feet; Variance requested is for 1,800 square feet. §154-105 A(4) of the Code states that the floor area of the apartment shall not exceed 35% of the entire livable floor area of the single-family principal dwelling and the accessory apartment combined; Accessory apartment is 44% of the entire livable floor area; Variance requested is for 9%. 2) Jing Zhang Case #16-11 – Area Variance – Held over from the October 19, 2011 meeting
Applicant is requesting an area variance pursuant to §154-7 of the Patterson Town Code, Schedule of Regulations, in order to construct a 12’ x 12’ shed attached to an existing garage. Applicant also wishes to construct a roof (breezeway) between the dwelling and garage with a rear overhang; and a ground level front deck. By adding the roof and attaching the shed to the garage, all structures become one (principal) structure. The Code requires there to be a side yard setback of 15’; Applicant can provide 0’; Variance requested for is 15’. This property is located at 9 Saginaw Road (RPL-10 Zoning District).
3) Joseph Francise, Jr. Case #17-11 – Area Variances – Held over from the October 19, 2011 meeting
Applicant is requesting an area variance pursuant to §154-58 of the Patterson Town Code, Enlargement of nonconforming buildings and §154- 7 of the Patterson Town Code, Schedule of regulations. Applicant wishes to square off the left rear corner of his dwelling in order to enlarge an existing bedroom. The Code requires there to be a 15’ side yard setback; Currently exists is 3.02’; Applicant is proposing a 2’ setback. The Code also allows for impervious coverage to be ≤38%; Applicant is proposing 52%; Variance requested is for 14%. Applicant also wishes to add a one-car garage and relocate the living room to above the garage and also add a front porch. This property is located at 14 Cornwall Court (RPL-10 Zoning District).
4) Margaret Burns Case #18-11 – Area Variance
Applicant is requesting an area variance pursuant to §154-7 of the Patterson Town Code, Schedule of regulations, in order to construct an 8’ x 14’ deck over an existing set of stairs which lead to the dwelling entry. The Code requires a minimum side yard setback of 15’; Applicant is proposing 13.5’; Variance requested for is 1.5’. This property is located at 85 Slater Road (RPL-10 Zoning District).
5) Christopher Fisher Case #19-11 – Area Variance
Applicant is requesting an area variance pursuant to §154-58 of the Patterson Town Code, Enlargement of nonconforming buildings. Applicant wishes to replace and enlarge a pre-existing nonconforming porch/deck on the south side of his residence. The Code requires there to be a 30’ side yard setback; Currently exists is 14’5”; Will exist 14’5”. This property is located at 15 South Street (R-1 Zoning District).
6) William Beltran Case #20-11 – Area Variances
Applicant is requesting area variances pursuant to §154-27 A(12) (a) & (b) of the Patterson Town Code, Permitted accessory uses. The property is diagonally divided by the NY/CT state line, which by our Code, becomes the property line, creating two front yards and a side yard. Applicant constructed a 21’ above ground pool and deck in the front yard and within the side yard setback. Section 1. Legislative Intent
It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Carmel, County of Putnam pursuant to General Municipal Law § 3-c, and to allow the Town of Carmel, County of Putnam to adopt a town budget for (a) town purposes (b) fire protection districts and (c) any other special or improvement district governed by the Town Board for the fiscal year 2012 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c.
Section 2. Authority.
This local law is adopted pursuant to subdivision 5 of General Municipal Law § 3-c, which expressly authorizes the town board to override the tax levy limit by the adoption of a local law approved by a vote of sixty percent (60%) of the town board.
Section 3. Tax Levy Limit Override.
The Town Board of the Town of Carmel, County of Putnam is hereby authorized to adopt a budget for the fiscal year 2012 that requires a real property tax levy in excess of the limit specified in General Municipal Law § 3-c.
Section 4. Severability.
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5. Effective date.
This local law shall take effect immediately
